As a busy mom, I understand the importance of flexibility and convenience. My husband and I put off our estate planning for years (yes, you read that right!) because we couldn’t seem to sync our schedules and meeting with an estate planning attorney sounded like so much extra work for us.

 

With this in mind, On Point Estate Law, Inc., operates on a mostly virtual basis. The goal is to create a seamless process that is easy for you - you don't need to leave the comfort of your home or office to come to mine.

 

To save you time, travel, and stress, most of our communications will occur virtually. We'll use a secure online client portal that can be used to communicate, exchange and review important documents (24/7 availability), and even sign when appropriate (some documents may need to be signed in person). Video calls, texts, and emails are also available to make your estate planning journey a smooth and seamless experience. If an evening or weekend appointment works better for you, I get it - just ask and we’ll find a time to make it work.

 

Am I too young for an estate plan?

No matter your age, you should plan for the unexpected. Any person over 18 years old should have a durable power of attorney, an advance health care directive, a living will, and HIPAA authorization. If you own property in California or have minor children, you should put your estate plan in place.


Do I need a trust?

In California, If you own real property or other assets of significant value, you need a living trust. If you own over $184k in assets, you need a trust.


What is probate?

There are different types of probates at different lengths and costs, depending on how much the property is worth. Probate can take a year to two years and can be five to ten percent of the estate. If the estate is worth more than $150k, it usually ends up in probate court. The fees to administer probate are statutory, meaning set and imposed by law. Here are some examples of statutory fees:

  • $500,000 estate will pay $26,000

  • $1,000,000 estate will pay $46,000

  • $2,000,000 estate will pay $66,000

  • $5,000,000 estate will pay $126,000

Court costs and other fees add an additional several thousand dollars to the statutory (and extraordinary) legal fees to make Probate Administration notoriously expensive in addition to being very time-consuming and public.

Protecting Your Kids Should the Unthinkable Should Happen

Have you considered who will be appointed guardian for your child in the short or long-term if something happens to you? 

  • Naming someone a godparent is not enough. Without a concrete plan, someone who may not be your ideal choice will be appointed for you. 


There are ways to protect your child while you are alive.

  • While child’s grandparents or babysitter may know your child’s allergies, do they have the authorization to make medical decisions at the emergency room?

Mom, wife, daughter, sister, friend, and survivor. At 27 years old and pregnant, I was diagnosed with a rare form of cancer known as triple negative breast cancer. My son had nearly 6 months of chemotherapy with me while I was pregnant. Today, he is 6 feet tall and almost 16 years old! Because of our sudden, life-altering diagnosis, I know the importance of planning for emergencies and protecting for my family's future.

Triumphed over adversity, Jamie has made significant contributions in the legal, academic, and personal spheres throughout California. With 20 years of legal experience serving as a prosecutor and cancer rights attorney, Jamie has established herself as a trusted advocate for her clients. With a deep understanding of the legal landscape, she provides comprehensive legal counsel and representation to individuals and families in a meaningful way that puts people first.

In addition to her legal practice, Jamie is a respected professor in San Diego, where she inspires and mentors the next generation of legal professionals. As an attorney, cancer survivor, and professor, Jamie's journey is a testament to determination, resilience, and the power of education.

On Point Estate Law, Inc., is a virtual estate planning law firm that serves clients throughout California. The firm’s home base, in the quintessential neighborhood of Point Loma at the point of the beautiful San Diego peninsula, serves as its namesake, On Point Estate Law, Inc.

The firm is surrounded by rich history that is anchored at Liberty Station, the former Naval Training Center, which served as the training ground to countless recruits, including my own father in 1967.

Liberty Station is conveniently located in central San Diego. Local clients have the option of meeting in-person for the final estate document signing at Moniker Commons, which is located inside Liberty Station at 2869 Historic Decatur Rd, San Diego, CA 92106.
